1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Viewing.One platform, website, and related services (collectively, the "Service") operated by Viewing One ("we", "us", or "our").
By registering for and using the Service, you ("Agent", "you", or "your") agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. Description of Service
Viewing.One provides a white-label platform that enables real estate agents to list properties, manage viewing availability, and receive booking requests from prospective buyers or tenants ("Visitors").
Viewing.One acts solely as a technology intermediary. We facilitate communication between Agents and Visitors but are not a party to any transaction, viewing agreement, sale, lease, or other arrangement entered into between an Agent and a Visitor.
3. Agent Registration and Account
3.1 You must provide accurate, current, and complete information during registration and keep your account information updated.
3.2 You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3.3 You must notify us immediately of any unauthorised use of your account or any other breach of security.
3.4 We reserve the right to suspend or terminate your account if any information provided is found to be false, misleading, or incomplete.
4. Agent Obligations
4.1 You represent and warrant that all property listings you submit are accurate, truthful, and not misleading.
4.2 You are solely responsible for the content of your listings, including descriptions, pricing, images, and availability.
4.3 You agree to respond to booking requests in a timely and professional manner.
4.4 You shall not misuse the Service to spam, harass, or deceive Visitors or other users.
4.5 You shall comply with all applicable laws, regulations, and professional codes of conduct in your jurisdiction, including but not limited to the Estate Agency Affairs Act (South Africa) and any applicable consumer protection legislation.
5. Bookings and Viewings
5.1 Viewing.One facilitates the scheduling of property viewings but does not guarantee that any booking will occur or that any party will attend a scheduled viewing.
5.2 Agents are responsible for confirming, rescheduling, or cancelling viewings directly with the Visitor.
5.3 We are not liable for any no-show, late arrival, miscommunication, or dispute arising from a scheduled viewing.
6. Limitation of Liability
6.1 To the maximum extent permitted by law, Viewing One, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of business opportunities, loss of data, or cost of procuring substitute services, arising out of or in connection with your use of the Service.
6.2 Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim.
6.3 We do not guarantee that the Service will be uninterrupted, secure, or error-free at all times. The Service is provided on an "as is" and "as available" basis.
7. Disclaimer of Warranties
7.1 The Service is provided without any warranty, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7.2 We do not warrant that (a) the Service will meet your specific requirements, (b) the Service will be uninterrupted, timely, secure, or error-free, or (c) any errors in the software will be corrected.
7.3 Any material downloaded or otherwise obtained through the use of the Service is done at your own discretion and risk.
8. Indemnification
You agree to indemnify, defend, and hold harmless Viewing One, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service;
- Your violation of these Terms;
- Your violation of any third-party right, including any intellectual property or privacy right;
- Any content you submit, post, or display through the Service;
- Any dispute between you and a Visitor arising from a booking or viewing.
9. Privacy
9.1 Your use of the Service is subject to our Privacy Policy, which forms part of these Terms.
9.2 By using the Service, you consent to the collection, storage, and processing of your personal information as described in the Privacy Policy.
9.3 We take reasonable measures to protect your data but cannot guarantee absolute security of data transmitted over the internet.
10. Intellectual Property
10.1 The Viewing.One name, logo, brand, and platform design are our intellectual property. You may not reproduce, distribute, or create derivative works without our express written permission.
10.2 You retain ownership of the content you submit (listings, images, profile information). By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to host, store, and display such content in connection with the Service.
11. Termination
11.1 You may terminate your account at any time by contacting us or using the account settings within the Dashboard.
11.2 We may suspend or terminate your access to the Service at any time, without notice, if you breach these Terms or if we reasonably believe that your use of the Service poses a risk to us or other users.
11.3 Upon termination, we will retain your data for a reasonable period as required by law, after which it may be deleted.
12. Changes to Terms
12.1 We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page.
12.2 Your continued use of the Service after any changes constitutes acceptance of the new Terms. We will notify you of material changes via email or through the Service.
13. Governing Law and Jurisdiction
13.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.
13.2 Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
